Lease Renewals

Renewing a commercial lease is a key milestone for both landlords and tenants and the process involves several steps to ensure the correct lease terms are agreed.

Key points

Is the lease protected by the Landlord and Tenant 1954 Act, security of tenure provisions?

If yes, have any notices been served by landlord or tenant?

If the lease is protected under the 1954 Act a new lease on similar terms to the existing lease can be agreed, subject to rent and term (depending on market conditions and business requirements).

All lease terms can be looked at for leases that do not have the protection of the 1954 Act.

Market research will be conducted to determine the market rent in consideration of other lease terms.

Negotiations to secure the best possible terms (including rent, term and other lease clauses).

If the renewal process becomes contentious advice on PACT.

Regears

A lease re-gear can be a strategic move for both landlords and tenants, offering an opportunity to renegotiate lease terms that better suit evolving business needs or market conditions.

Examples of lease re-gears:

  • Lease Extension

  • Removal of break clause

  • Pushing a break clause out

  • Removal / Addition of other lease terms

Whatever your lease re-gear requirements, we’re here to negotiate the best outcome for you.
